Agency Disclosure Requirements in New York
New York real estate agents must provide a written Agency Disclosure Form to consumers at the “first substantive contact” in residential property transactions, as required by Real Property Law (RPL) §443. This form clarifies the agent’s role, relationship, and obligations, ensuring that consumers can make informed choices. The disclosure is required for both buyers and sellers and must be signed by the consumer to acknowledge receipt. In commercial transactions, disclosure should also be made in satisfaction of 19 NYCRR 175.7, where a real estate broker is charged with making clear for which party he is acting.
In New York, real estate salespersons, brokers, and associate brokers must complete 1 hour of agency disclosure education every 2 years. New licensees who have been licensed for less than two years are required to complete 2 hours of agency disclosure continuing education.

Agency disclosure isn’t just paperwork — it’s a legal duty that carries serious consequences when done wrong. New York real estate professionals have faced Department of State administrative complaints resulting in:
- Fines of up to $2,000 per violation
- Official reprimands on their license record
- License suspension or revocation
- Forced return (“disgorgement”) of earned commissions
Beyond regulatory action, brokers and salespersons (agents) may also face civil lawsuits for breach of fiduciary duty, exposing them to both direct and consequential damages. Learning from real estate brokerage attorneys ensures you understand not only how to complete the Agency Disclosure Form correctly, but why every detail matters legally. This course translates complex statutes and Department of State decisions into practical steps that help you avoid costly mistakes and build client trust through compliance.
