How can you be held liable in a discrimination lawsuit if you didn’t intend to do it? Did you know that unintentional discrimination can get you sued everywhere throughout the United States? The Fair Housing Act, the New York State Human Rights Law, and the New York City Human Rights Law each support a lawsuit for unintentional conduct, called a disparate impact lawsuit. Each also provides for failure-to-accommodate lawsuits where intent is irrelevant to a claim. Finally, each provides that intentional discrimination, called a disparate treatment lawsuit, can be proven through circumstantial evidence because mind reading isn’t an acceptable tool of judicial inquiry.
